Online ticket sales - Terms and Conditions

 1. INTRODUCTION

a) Welcome to the Royal Flying Doctor Services website located at http://.dubbo.experience.flyingdoctor.org.au (“Site”). 

b) The Site is owned and operated by Royal Flying Doctor Service of Australia (South Eastern Section) ABN 86 000 032 422 (“RFDS”, “We”, “Our” and “Us”).

c) These Terms and Conditions govern the online sale and purchase of tickets via the Site for admission of a Visitor Experience Centre located at 21 Judy Jakins Drive, Dubbo 2830, NSW, Australia ("Centre").

d) Reference to "you" and "your" refer to each ticket buyer of the ticket via the Site.

e) By purchasing tickets via the Site you are deemed to have read, understood and agreed to these Terms and Conditions and you agree that these Terms and Conditions represent a binding agreement between you and RFDS.

f) RFDS reserves the right to change these Terms & Conditions at any time without notice to you.

2. CONDITIONS OF SALE

a) All tickets offered for sale by RFDS are sold on a first come first served basis and we do not guarantee the availability of the tickets in any given day.

b) All tickets purchased via the Site are emailed to your nominated email address. It is your responsibility to print off and present a valid ticket at the Centre for admission.

c) Any tickets purchased via RFDS must not be re-sold, offered for re-sale, be on-sold at a premium, offered as a prize or inducement, packaged or otherwise used for advertising, promotional or other commercial purposes, or given to any person other than the person named on the ticket, without the prior written consent of the RFDS, which may be withheld in RFDS’s absolute discretion. 

 

3. CONDITIONS OF ENTRY

a) You must hold a valid ticket purchased via the Site and may be required to produce valid photo identification which corresponds with the name on the ticket in order to be admitted to the Centre.

b) One ticket purchased entitles one person entry to the Centre on a single occasion. Once you have left the Centre, you will need to purchase an additional ticket to re-enter the Centre.

c) You may only enter into the Centre during the opening hours of the Centre, as shown on the Site.

d) RFDS reserves the right to change the opening hours of the Centre and close the Centre for any reason at any given day, in its absolute discretion, without prior notice to you.

e) RFDS reserves the right to refuse entry to any person who does not hold a valid ticket, valid photo identification, who arrives outside of the opening hours of the Centre, or who is intoxicated.

f) RFDS reserves the right to reject you from entering into the Centre (in their sole discretion), in accordance with the law.

g) RFDS reserves the right to determine whether you may or may not bring cameras or other recording equipment to the Centre. Any restrictions in relation to cameras and recording equipment will be notified to you prior to entering into the Centre, or at the Centre.

h) You are required to retain your ticket throughout your visit at the Centre and may be asked to present your ticket at any time when you are at the Centre.

 

4. REFUNDS, EXCHANGES AND REPLACEMENTS

a) Subject to this Clause 4, all tickets purchased via the Site are non-refundable and non-exchangeable unless RFDS permits a refund or exchange, or unless RFDS is legally required to do so. In the event that RFDS does provide a refund or exchange, it may be subject to certain conditions and additional fees.

b) RFDS is under no obligation to replace lost or stolen tickets for any tickets sold via the Site.

c) If the Centre, for any reason, is closed during the opening hours as shown on the Site, you may request a refund of the tickets from RFDS with RFDS' consent and such consent should be not unreasonably withhold.

d) RFDS shall be under no obligation to arrange a substitute or replacement of the ticket, in the event that the opening hours of the Centre are changed.

e) Ticket valid for one year from the date of purchase.

 

5. OUR RIGHT TO CANCEL TICKETS

If we believe that a ticket sold via the Site was purchased fraudulently, we reserve the right to cancel such ticket in our sole discretion without notice to you.

 

6. PAYMENT and PURCHASE OF TICKETS

a) At the point of purchase all ticket prices are listed in Australian dollars and are stated inclusive of GST, except where otherwise stated.

b) RFDS accepts the following methods of payment for ticket purchases via the Site: external payment gateways including PayPal and Stripe.

c) All bank charges and fees incurred by you in connection with the purchase of a ticket via the Site shall be your sole responsibility. 

 

7. NO WARRANTIES & DISCLAIMER

a) The Site is provided on an "as is" basis and without representations or warranties of any kind to you, whether express or implied, including without limitation as to the quality and/or fitness of the Site for a particular use, accessibility, or warranties that access or use of the Site will be uninterrupted or error-free, or that the Site will be secure or free of viruses or other harmful material or elements, or that any of the content on the Site will be correct, accurate, timely or complete.

b) We use reasonable efforts to ensure the integrity of the Site, however, we do not and can not warrant that your use of this Site will be error free or uninterrupted. The Site may include technical inaccuracies or typographical or other types of errors. RFDS has the right to make changes, modifications and updates to any materials contained on the Site in its sole discretion and without prior notice.

c) Except as expressly provided to the contrary in this Agreement, and to the fullest extent permitted by law, all terms, conditions and warranties whether implied, statutory or otherwise relating to this Agreement are excluded.

d) Neither RFDS, or its affiliates, directors, officers, employees, agents or contractors, will be liable for any damages, costs, loss or liability arising or in any way related to the provision of the Site, nor do we accept any responsibility for any such loss arising out of your use of, or reliance on, information contained on or accessed through this Site.

 

8. PRIVACY and TERMS OF USE

a) RFDS collects your individual information so it may process the payment of the ticket and contact you in the event of closure of the Centre or variation to opening hours of the Centre. All personal information is held by RFDS in accordance with its Privacy Policy.

b) These Terms and Conditions incorporate and are to be read in conjunction with RFDS’ Terms and Conditions of Use and the RFDS' Privacy Policy.

9. GOVERNING LAW AND JURISDICTION

This Terms and Conditions are governed by the laws in force in New South Wales, Australia and you submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia and any courts which may hear appeals from those courts in respect of any proceedings in connection with this Terms and Conditions and the Site.

10. GENERAL

We accept no liability for any failure to comply with these Terms and Conditions where such failure is due to circumstance beyond our reasonable control.

If we waive any rights available to us under these Terms and Conditions on one occasion, this does not means that those rights will automatically be waived on any other occasion.

These Terms and Condition, Terms and Conditions of Use and our Privacy Policy form our entire agreement with you. Any other terms and conditions, or representations will be excluded to the extent permitted by law.
